Marketplace Vendor Rules
1. Account & Registration
- Accurate Information: Vendors must provide true, accurate, and complete information during registration. Any misrepresentation, including false addresses, business names, or product details, will result in account suspension or termination.
- Verification: All vendor accounts must go through a verification process, including business identity, tax status, and contact information.
2. Product Listings
- Authenticity: Vendors must only list authentic, legally obtained, and original products. Counterfeit, illegal, or plagiarized goods will not be allowed.
- Prohibited Items: Vendors may not list prohibited items such as weapons, illicit drugs, hazardous materials, or items that violate local, state, or international laws.
- Digital Content Only: Only digital content may be sold on this Marketplace. This includes software, music, eBooks, videos, and other digital products. Vendors selling digital content must own the rights to that content, and the content must not violate copyright law. Any content sold must be created, owned, or licensed by the vendor.
- Request for Physical Products: Vendors wishing to sell physical products may request special permission via email to marketplace@justinsanjp.de. Vendors approved to sell physical products will be labeled as “Featured Sellers” on the platform.
- Product Descriptions & Accuracy: Product descriptions must be clear, accurate, and complete. Vendors must not engage in misleading advertising, and any misrepresentation of product features, quality, or origin will lead to penalties.
- Pricing Integrity: Vendors must set prices that are reasonable and reflect the true cost of the product, including any relevant taxes, fees, and shipping costs.
- Stock Availability: Vendors must maintain accurate inventory levels. Products listed as available must be in stock, and any stockouts should be updated promptly.
3. Shipping & Fulfillment
- Timely Shipping: Vendors must ship products within the agreed timeframe after receiving an order. Any delays must be communicated to the buyer with a valid reason.
- Packaging: Vendors must ensure that all products are appropriately packaged to prevent damage during shipping. Damaged goods due to improper packaging will lead to penalties.
- Shipping Tracking: Vendors are required to provide valid tracking information for every order shipped, ensuring transparency in the delivery process.
4. Customer Service & Communication
- Prompt Response: Vendors must respond to customer inquiries and complaints within 24 hours. Failure to address customer concerns promptly will lead to account review.
- Refunds & Returns: Vendors must honor the Marketplace’s return and refund policies. In case of defective, damaged, or incorrect items, vendors are responsible for processing returns and issuing refunds.
- Respectful Interaction: Vendors must engage with customers in a professional and respectful manner. Discriminatory, rude, or unprofessional behavior will result in immediate suspension.
5. Reviews & Feedback
- Honest Reviews: Vendors must not solicit, fabricate, or manipulate reviews. Encouraging false reviews, whether positive or negative, is strictly prohibited.
- Handling Negative Reviews: Vendors must address negative feedback professionally and attempt to resolve customer issues. Repeated negative reviews without attempts at resolution will lead to penalties.
6. Compliance with Legal and Tax Obligations
- Tax Compliance: Vendors are responsible for complying with all relevant tax laws and regulations in the jurisdictions where they operate, including sales tax collection and remittance.
- Licensing: Vendors must hold all required licenses, permits, and registrations for their products and services in accordance with applicable laws.
7. Ethical Practices
- Fair Competition: Vendors must not engage in unfair business practices such as price manipulation, bait-and-switch tactics, or other deceptive marketing strategies.
- Environmental Impact: Vendors should consider sustainability in their operations, such as using eco-friendly packaging, offering products with minimal environmental impact, or supporting ethical sourcing.
8. Marketplace Fees & Payments
- Payment Processing: Vendors must ensure that payments are processed through the designated payment system on the platform. Transactions conducted outside the platform are strictly prohibited.
- Fee Compliance: Vendors are required to pay all applicable fees as outlined in the Marketplace agreement, including listing fees, transaction fees, and other associated charges.
9. Security & Data Protection
- Customer Data Protection: Vendors must protect the privacy of customer data, and not misuse, sell, or share any personal information outside of the normal business operations required for processing transactions.
- Fraud Prevention: Vendors must take reasonable steps to detect and prevent fraudulent activities, such as unauthorized chargebacks or orders from suspicious accounts.
10. Dispute Resolution
- Resolution Process: In the event of a dispute, vendors must follow the Marketplace’s established dispute resolution process. Any refusal to participate in or comply with the process can result in account suspension.
- Resolution Timeline: Disputes must be resolved within a defined timeframe, typically 5 business days, or they will be escalated for further review.
11. Limitation of Liability
- Marketplace Liability: The Marketplace owner assumes no liability for the products sold by vendors on the platform. Vendors are fully responsible for the content and quality of their own items, including any legal issues, claims, or disputes that arise from the sale of their products.
- Indemnity: Vendors agree to indemnify and hold harmless the Marketplace owner from any claims, damages, losses, or liabilities arising out of or related to the vendor’s products, transactions, or violations of these rules.
12. Termination & Suspension
- Non-Compliance: Any vendor found violating the rules outlined above may face account suspension or permanent removal from the Marketplace.
- Appeals: Vendors have the right to appeal decisions that result in account suspension or termination. Appeals must be submitted within 10 days of the notice, and will be reviewed by the Marketplace’s support team.
13. Marketplace Rights
- Policy Updates: The Marketplace reserves the right to update, amend, or change these rules at any time. Vendors will be notified of any updates and must comply with new policies.
- Marketplace Monitoring: The Marketplace may monitor vendor activity to ensure compliance with these rules and investigate reports of violations.
